Representations
• Mr. Li had been working for Chinese governmental authorities (including Beijing Municipal Foreign Trade and Economy Commission, China Ministry of Foreign Trade, and Economic Cooperation) since early 1980s. His main responsibility was on scrutiny and regulation of foreign investment. Since late 1980s, Mr. Li had been involved in drafting many laws, regulations, and rules such as Beijing Regulations Regarding Dissolution of Foreign Invested Enterprises, Beijing Measures Concerning Liquidation of Foreign Invested Enterprises, Implement Rules on Law of Protection of Investment by Taiwanese, Certain Provisions Concerning Shareholding Change of Foreign Invested Enterprises, Amendment on PRC Law of Sino-Foreign Equity Joint Venture, Amendment on PRC Law of Sino-Foreign Cooperative Joint Venture, and Amendment on PRC Law of Wholly Foreign Owned Enterprises. The main investigation and investigation report issued by Mr. Li include: investigation into situation in respect to senior officers of foreign invested enterprises in Beijing, into operation of (branches of) foreign bank in Shenzhen, Zhuhai and Xiamen, into foreign invested agency of futures, into illegal CD-making business, pyramid selling of foreign invested enterprises, and into the implementation of laws regarding foreign invested enterprises. Since 1996, Mr. Li had been a member of Investment Expert Group of Committee on Trade and Investment under Asia-Pacific Economic Cooperation (“APEC”). He also gave lectures on law and policy issues concerning FIEs as well as contracts and articles of associations of FIEs to around 1000 attendants (local officials and businessmen) on various occasions.
• Mr. Li has participated in anti-dumping investigations conducted either by Chinese or some foreign authorities. During his stay with the Bureau of Fair Trade of MOFCOM, he investigated many cases as a team leader in respect to initiation, drafting of questionnaire, on-site verification, hearings, preliminary findings, final determinations, and bilateral consultations with foreign representatives. In respect to representation in anti-dumping and other trade remedy investigations, Mr. Li has acted on behalf of some responding enterprises in several dozens of anti-dumping cases. In addition, Mr. Li has been a counsel of Chinese Ministry of Commerce in certain dispute resolution proceedings before WTO penal and the Appellate Body as a third party. For instance, Untied States - upland cotton subsidy (DS267) by Brazil, Mexico. Soft drink Tax (DS308) by the United States, and Untied States. Foreign Sales Corporation (DS108) by European Community. Mr. Li took part in formulating the major amendment of PRC Foreign Trade Law during 2001-2004, he also contributed to negotiation concerning Doha round of negotiation on the Anti-Dumping Agreement, and he had, in addition, worked on the formulation of certain regulations and/or rules regarding anti-dumping investigation in China.
• Mr Li for a long time was the senior delegate of Chinese group for Forum of Competition Policy and Deregulation organized by Committee of Trade and Investment (CTI) of APEC and contributed to formulating and finalizing of APEC Principles to Enhance Competition and Regulatory Reform. He had also advised the authorities concerned for formulation of PRC Law of Anti-Monopoly and implementation of the Regulation on Merger and Acquisition by Foreign Investors. A member of a cooperative project jointly held by APEC-OECD in respect of regulatory reform is another position that Mr. Li once held. He also provides consultation to APEC and OECD on the Chinese progressive approach to regulatory reform, and to the Ministry of Commerce of China on regulatory impact analysis. Mr. Li had also advised a number of companies from China or Belarus in respect to regulation in China on mergers or anticompetitive practices.
